TERMS AND CONDITIONS OF SALE

Article 1. Scope of the T&Cs

PJTA TICKETING, hereinafter referred to as "PJTA Ticketing", is a single-member simplified joint-stock company (SASU) with a share capital of 40,000 euros, registered with the Paris Trade and Companies Register under number 922 314 380 R.C.S. Paris, with its registered office at 3 place des Pyramides, 75001 Paris, France, and whose intra-community VAT number is FR13922314380.

PJTA Ticketing is represented by its President, EUROPE TOURISME, a simplified joint-stock company registered under number 798 030 748 R.C.S. Paris. Its APE code is 79.11Z - Travel agency activities.

PJTA Ticketing notably carries out activities and services related to tourist reception, marketing and the distribution of tickets for leisure activities, experiences and events, by all physical and/or dematerialized means.

The website www.parisjetaime.com, hereinafter the "Site", contains different areas, including information areas accessible to any visitor, areas reserved for certain users, as well as free or paid areas on which PJTA Ticketing notably offers a ticketing service for tourism and leisure services, such as excursions, cruises, tours, admission tickets to certain museums, monuments, amusement parks or events, packages including admission tickets and transport passes, discount booklets, as well as an online booking service relating notably to catering services or experiences.

These general terms and conditions of sale, hereinafter the "T&Cs", concern orders and/or bookings made and paid for in whole or in part online on the Site by the User, as well as orders and/or bookings made directly at reception points operated or designated by PJTA Ticketing in connection with the use of ticketing and online booking services, hereinafter the "Services".

Excluded from the scope of these T&Cs are bookings and/or orders for which the Site redirects the User to third-party partner providers. These services are provided and managed exclusively by and under the responsibility of those third-party partners, in accordance with their own contractual conditions.

Article 2. Definitions

The terms used with an initial capital in these T&Cs shall have the meaning given below, whether used in the singular or plural.

  • "Durable medium" means any instrument enabling the consumer or the professional to store information addressed personally to them so that it can be consulted later for a period of time appropriate to the purpose for which the information is intended, and allowing the identical reproduction of the stored information.
  • "Dated Ticket" means a Service that is valid only for the date and/or time slot set at the time of the order. The Dated Ticket may be delivered in dematerialized form, notably as an electronic ticket sent by email or downloadable from the Site.
  • "Undated Ticket" means a Service that is valid over a specified period and usable on the date and/or at the time chosen by the Customer, subject to the specific conditions of the Service concerned.
  • "Exceptional and unavoidable circumstances" means any event beyond the control of both the professional and the Customer, the consequences of which could not have been avoided even if all reasonable measures had been taken.
  • "Partner" means the provider or providers of the Services offered on the Site.
  • "Service" means any service provision, notably transport, leisure, visit, experience, ticketing or catering, provided by a Partner and that may be ordered or booked from PJTA Ticketing on the Site.
  • "Service" means the ticketing, booking or sales service offered by PJTA Ticketing on the Site and enabling the online purchase or booking of Services.
  • "Customer" means any user of the Site, whether a natural person or a legal entity, acting as a consumer, non-professional or professional, who books, orders and/or purchases one or more Services offered on the Site.

Article 3. Pre-contractual information

The Customer acknowledges having received, before placing their order and/or concluding the contract, in a readable and understandable manner and on a durable medium, these T&Cs, the specific information relating to the ordered Service, as well as all legally required information, notably that provided for by the Consumer Code and, where applicable, by the Tourism Code.

Where the nature of the Service requires it, the Customer acknowledges having received information relating to the essential characteristics of the Service, the price, the payment terms, the cancellation conditions, any access restrictions, the validity conditions of the tickets and the contact details for submitting a complaint.

Article 4. Price and payment terms

4.1 Final price and additional taxes

The final price is announced in euros, all taxes included (TTC), unless otherwise stated. The price includes the items indicated in the Service description and, where applicable, the online booking fees and shipping costs expressly mentioned when ordering.

Unless otherwise stated in the Service description, the price does not include transport costs not expressly included, personal expenses, optional insurance, local taxes or charges payable directly to a Partner or third party.

4.2 Payment terms

The Customer guarantees to PJTA Ticketing that they have any authorizations required to use the payment method chosen at the time of order validation. PJTA Ticketing reserves the right to suspend any booking management and any performance of the Services in the event of refusal of card payment authorization by officially accredited bodies or in the event of non-payment of any amount due.

PJTA Ticketing reserves the right to refuse to honor a booking from a Customer who has not fully or partially paid for a previous booking or with whom a payment dispute is ongoing.

Payments made by the Customer shall be considered final only after the amounts due have actually been collected by PJTA Ticketing or its payment provider.

  • bank card or other payment method accepted on the Site at the time of the order;
  • SEPA transfer, PayPal transfer or any other method indicated when ordering, where that method is offered;
  • holiday vouchers or any other payment method accepted only at reception points, if that method is offered;
  • check or administrative payment order, only where this method is expressly accepted for certain bulk sales or specific orders.

Article 5. Ordering or booking on www.parisjetaime.com

5.1 Conditions required before using the Services

Any order or booking made and paid for through the Site presupposes the Customer's prior, full and unconditional acceptance of these T&Cs, materialized by the checkbox provided for this purpose. Without this acceptance, continuing the order or booking process is technically impossible.

The characteristics of the Services that may be ordered or booked are shown on the Site. The photographs, illustrations and visuals presented are non-contractual. By ordering or booking a Service on the Site, the Customer acknowledges having obtained the desired information about the nature and essential characteristics of that Service.

The Customer must be at least 18 years old, legally capable of entering into a contract and using the Site in accordance with these T&Cs. Minors must be accompanied by at least one adult where the Service requires it.

The Customer certifies the truthfulness and accuracy of the information communicated to PJTA Ticketing in connection with the use of the Services. The Customer indemnifies PJTA Ticketing against any action or claim by third parties arising from unlawful, fraudulent or erroneous use of their data.

5.2 Online contracting process applicable to the Services

These T&Cs are provided in French. In the event of a translation or foreign-language version, only the French text is binding in the event of inconsistency. They may be consulted at any time on the Site.

The Customer may keep the T&Cs by saving or printing them using the standard features of their browser or device. PJTA Ticketing archives contracts concluded on the Site where regulations require it.

The Customer may request access to the archives of their contracts by sending a request to PJTA Ticketing, 3 place des Pyramides, 75001 Paris, France, together with any information establishing that they are the contracting party concerned, as well as a copy of their identity document where necessary for identification purposes.

The procedure for placing an order or making a booking on the Site is based on the double-click technique and includes notably the following steps:

  1. selection by the Customer of the desired Service after reviewing its essential characteristics and, where applicable, selection of the delivery method;
  2. completion of the mandatory fields in the order or booking forms;
  3. verification of the summary displayed on the Site, notably recalling the selected Service, the total price, the information entered by the Customer, and the possibility of correcting any error before validation;
  4. unreserved acceptance of these T&Cs;
  5. final confirmation of the order or booking after entry and validation of the information relating to the selected payment method.

The contract concluded online by the Customer with PJTA Ticketing becomes firm and final when the Customer has confirmed the information entered and the selected Service, accepted the T&Cs and, where applicable, the contractual terms of the Partners without reservation, and then paid in full the price due to PJTA Ticketing.

PJTA Ticketing sends an order or booking confirmation email to the address provided by the Customer in good time before the start of the ordered or booked Service and, except in particular circumstances, within a maximum period of seventy-two (72) hours from receipt of the order or booking. The Customer is invited to check their inbox and spam folder.

This email contains the useful contractual information, notably the Services ordered, the identification of the supplying Partner, the price paid to PJTA Ticketing, any delivery fees and the complaint procedures.

It is the Customer's responsibility to download their e-tickets or supporting documents from the confirmation email or from the Site, and then to present them, either printed or on a mobile device, to the Partner or the relevant checkpoint. A simple bank receipt does not constitute proof of booking or order.

Article 6. Specific conditions relating to the ticketing Service

6.1 Validity period of booked Services

The tickets that may be ordered on the Site are generally subject to a specific validity period or, for some of them, to a specific date and/or time slot. By confirming the order, the Customer acknowledges having taken note of the applicable date, time slot or validity period. Any ticket not used under the stated conditions shall neither be refundable nor exchangeable, unless otherwise specifically provided.

6.2 Delivery and collection procedure

Once the contract has been definitively concluded, PJTA Ticketing proceeds with delivery of the order according to the method selected by the Customer when placing the order, where delivery is offered. The proposed delivery methods, places, countries and estimated times, as well as any shipping fees, are indicated on the Site when ordering.

The order may also be collected by the Customer at one of the reception points indicated on the Site, upon presentation of the order confirmation email. The order may also be delivered in the form of an e-ticket.

Where the Customer chooses collection at a reception point, they must comply with the collection period indicated when ordering. If the order is not collected within the indicated period, it may no longer be available and the Customer shall not be entitled to any refund, unless otherwise specifically provided.

In the event of remote delivery, the Customer must verify the conformity of the order upon receipt and report any anomaly as soon as possible. PJTA Ticketing cannot be held liable for delay in or impossibility of delivery resulting from an incorrect or incomplete address, an event attributable to the Customer, a malfunction of postal or transport services, or any external event beyond its reasonable control.

Article 7. Identity verification and fraud prevention

In order to prevent payment fraud and abnormal requests, PJTA Ticketing may implement a Customer identity verification process, notably where the order concerns a significant quantity of tickets, has an atypical nature or triggers a security alert from the payment provider.

In this context, PJTA Ticketing may ask the Customer to provide information or supporting documents making it possible to verify the identity of the holder of the payment method used. In the absence of a response within the stated period or in the event of inconsistent information, PJTA Ticketing reserves the right to cancel the order. The supporting documents provided are processed solely for verification purposes and deleted as soon as they are no longer necessary, subject to applicable legal obligations.

Article 8. Cancellation or modification of a Service

8.1 Modification of the contract at the initiative of PJTA Ticketing or the Partner

When the Customer orders a Dated Ticket, the dates, times and time slots offered are provided subject to availability from the Partner. It is possible that a Partner no longer has sufficient availability to honor or register the requested booking.

In that case, PJTA Ticketing informs the Customer of the unavailability and may offer an alternative date, time or time slot close to the one initially booked. If the new option does not suit the Customer, the Customer may, according to the conditions of the Service concerned, choose a new date or request a refund of the Dated Ticket.

8.2 Cancellation of the contract at the initiative of PJTA Ticketing or the Partner

PJTA Ticketing or the Partner may cancel a Service before it begins when the conditions for its performance are not met, notably where the minimum number of participants is not reached, where the Service becomes unavailable, or where exceptional and unavoidable circumstances prevent its normal performance.

In that case, the Customer is informed as soon as possible. Unless a specific stipulation or contrary legal obligation applies, the Customer is entitled to reimbursement of the amounts actually paid to PJTA Ticketing for the cancelled Service, without being entitled to claim additional compensation where the cancellation results from exceptional and unavoidable circumstances or from an event beyond PJTA Ticketing's control.

8.3 Modification and cancellation at the initiative of the Customer

The applicable conditions for modification, cancellation, exchange or refund are those indicated in the description of the Service, on the ticket, in the confirmation email or in the Partner's specific terms. Some Dated Services may be modified or cancelled up to a specific period before the scheduled date; others are not modifiable and are non-refundable.

Unless otherwise stated, Undated Services are neither exchangeable nor refundable. They remain valid until the expiry date stated on the ticket or in the specific terms of the Service.

Where cancellation or modification is possible, cancellation, file or processing fees may apply. No refund shall be made for any Service shortened, unused or started late for reasons attributable to the Customer.

PJTA Ticketing and/or the Partner reserve the right to grant a refund or a goodwill gesture on an exceptional basis, without this creating any vested right for the Customer.

PJTA Ticketing is liable to the Customer only for the Services it sells or invoices. It cannot be held liable for services not ordered, sold or invoiced by it, nor for modifications requested directly by the Customer from a third party.

Article 9. Absence of a right of withdrawal

In accordance with Article L.221-28 of the Consumer Code, the Customer is informed that they do not have a right of withdrawal in respect of the remote booking or ordering of accommodation, transport, catering or leisure services to be provided on a specific date or according to a defined periodicity.

As the right of withdrawal does not apply to the Services offered by PJTA Ticketing in these cases, the Customer is reminded that, unless otherwise specifically stated, any ticket order placed on the Site is final. Consequently, tickets ordered on the Site, whether Dated or Undated, are not refunded, taken back, exchanged or duplicated in the event of delay, loss or theft, unless otherwise specifically provided.

Article 10. Conditions for publishing reviews

10.1 Online reviews

An online review means the expression of a consumer's opinion about their consumer experience, based on any qualitative or quantitative assessment element.

10.2 Review ranking

Reviews published on the Site are displayed according to the criteria indicated on the relevant interface and, by default, from the most recent to the oldest.

10.3 No consideration

The Customer is informed that posting a review is free of charge and does not give rise to any consideration. By posting a review, the Customer grants PJTA Ticketing, for the purposes of operating the Site and the Services, a non-exclusive license to use, reproduce, publish, adapt and display the review, worldwide and for the duration necessary for operating the relevant Service, subject to the Customer's applicable rights regarding personal data.

10.4 Review moderation

Each review may be checked before publication. PJTA Ticketing reserves the right not to publish or to remove any content contrary to these T&Cs, public policy, third-party rights, rules relating to personal data, or presenting an insulting, defamatory, fraudulent, discriminatory, obscene, hateful, threatening, unlawful character, or unrelated to the Service concerned.

  • the rating given clearly does not correspond to the comment;
  • the content is unrelated to the product or service concerned;
  • the content contains personal or confidential information;
  • the content is clearly promotional, fraudulent or akin to spam;
  • the content contains a call for legal action or allegations likely to engage the liability of its author or PJTA Ticketing;
  • the content is incomprehensible or contains random characters.

10.5 Removal or reporting of a review

The Customer may request the removal of the review they posted or report content they consider inappropriate via the Site's contact form or by post to the following address: PJTA Ticketing, E-commerce Department, 3 place des Pyramides, 75001 Paris, France.

The request must make it possible to identify the review concerned, the first and last name of the requester, the contact email address, the order number where applicable, as well as any information justifying the request. A copy of an identity document may be requested where necessary for identifying the requester.

Article 11. Legal guarantee of conformity

PJTA Ticketing is required to provide a Service that conforms to the contract, under the conditions provided for by the applicable regulations. The consumer or non-professional Customer may submit a claim under the legal guarantee of conformity or the applicable legal guarantees, notably where the Service provided does not correspond to the order or presents a defect of conformity attributable to PJTA Ticketing.

The Customer must report defects or faults observed as soon as possible after the Service has been provided, together with supporting documents, so as to allow PJTA Ticketing to investigate and assess the reality of the alleged defects.

Where the defect of conformity is established, it may give rise, depending on the circumstances, to rectification, replacement, a price reduction or reimbursement, under the conditions provided by law and taking into account the significance of the non-conformity.

PJTA Ticketing's guarantee is limited to reimbursement of the Services actually paid for by the Customer to PJTA Ticketing, unless a mandatory legal provision provides otherwise. PJTA Ticketing cannot be held liable for delay or non-performance resulting from force majeure, exceptional and unavoidable circumstances, the Customer's own act, or the unforeseeable and unavoidable act of a third party.

Article 12. Protection of personal data

12.1 Data collected

As part of its Service sales activity, PJTA Ticketing carries out processing of personal data relating to Customers, Users and Beneficiaries. The data collected may notably include: first name, last name, title, postal address, email address, telephone number, information necessary for the order, payment methods, details noted in the contract and customer relationship tracking data.

12.2 Purposes

The collection of this data is necessary for contract performance and customer relationship management. If the Customer refuses to provide certain essential data, they may face difficulties in the performance of the Service which cannot give rise to PJTA Ticketing's liability.

The purposes of the processing are notably the following:

  • identification of persons using and/or booking the Services;
  • formalization and performance of the contractual relationship;
  • management of orders, bookings, payments, contracts and complaints;
  • communication to the relevant Partners for the performance of the Services;
  • accounting, invoicing and follow-up of the customer relationship;
  • commercial communications, prospecting and promotional activities, where permitted by the applicable regulations.

12.3 Recipients

The persons authorized to access the collected data are the teams of PJTA Ticketing, the Partners involved in the requested Services, as well as subcontracted providers involved in the performance, administration, payment or support of the Services, in compliance with the applicable regulations.

12.4 Retention and security

Personal data is retained for the time necessary for the purpose of the processing, increased where applicable by legal retention or limitation periods. Data relating to payment methods is retained under the conditions defined by payment providers and the applicable regulations.

PJTA Ticketing implements organizational, technical, software and physical measures designed to protect personal data against alteration, destruction, loss or unauthorized access. As the Internet is not a completely secure environment, PJTA Ticketing cannot absolutely guarantee the security of transmission or storage of information on the Internet.

12.5 Rights of data subjects

In accordance with the applicable regulations, each data subject notably has a right of access, rectification, erasure, objection, restriction of processing and, where applicable, portability of their data. These rights may be exercised via the Site's contact form or by post addressed to PJTA Ticketing, 3 place des Pyramides, 75001 Paris, France, accompanied, where necessary, by proof of identity.

The Customer may also lodge a complaint with the CNIL according to the procedures indicated on its website.

12.6 Amendment of the clause

PJTA Ticketing reserves the right to amend this clause relating to the protection of personal data at any time. In the event of a substantial amendment, PJTA Ticketing will publish the new version on the Site and, where required, inform the users concerned.

Article 13. Liability of PJTA Ticketing

PJTA Ticketing is liable as of right for the proper performance of the Services it sells or invoices to the Customer, under the conditions and within the limits provided for by the applicable regulations.

PJTA Ticketing may be released from all or part of its liability by proving that the damage is attributable to the Customer, to a third party unrelated to the provision of the Services and presenting an unforeseeable or unavoidable character, or to exceptional and unavoidable circumstances.

Where the Service is provided by a Partner, the characteristics, access conditions, schedules, restrictions and performance methods are determined by that Partner and presented on the Site according to the information available. PJTA Ticketing cannot be held liable for modifications or failures attributable exclusively to the Partner or to the Customer, subject to the Customer's mandatory rights.

In accordance with the applicable provisions, the amount of any damages that PJTA Ticketing could be ordered to pay to the Customer shall be limited under the conditions provided for by law, except in the case of bodily injury, damage caused intentionally or by gross negligence, and cases in which such a limitation would be prohibited.

Article 14. Accessibility

Despite the efforts of PJTA Ticketing and its Partners, certain Services, notably roaming, visit or outdoor activities, may not be accessible to persons with reduced mobility or may involve specific accessibility constraints. The Customer is invited to consult the information appearing in the description of the Service and to contact PJTA Ticketing before placing any order in the event of a particular need.

Article 15. Compliance with rules applicable to the Services

Certain Services taking place outdoors may require good physical condition, suitable shoes and clothing compatible with weather conditions. In natural, cultural, heritage or private spaces, participants must comply with rules of caution, circulation, hygiene, safety, protection of places and with the instructions of the guide, the Partner or the operator of the visited site.

PJTA Ticketing, the guide or the Partner reserve the right to exclude a participant who does not comply with these rules or who disrupts the performance of the Service, without such exclusion giving rise to reimbursement where the participant's behavior is at fault.

Article 16. Dispute resolution

These T&Cs are governed by French law, both as regards substantive and procedural rules.

In the event of difficulty, the Customer is invited to contact PJTA Ticketing's customer service as a priority via the Site's contact form or by post to the address of the registered office. PJTA Ticketing will endeavor to seek an amicable solution.

A Customer acting as a consumer may have free recourse to a competent consumer mediator, in accordance with the provisions of the Consumer Code, after having first sent a written complaint to PJTA Ticketing and in the absence of a satisfactory response within the applicable period.

If the Service was purchased online, the Customer is also informed that they may use the European online dispute resolution platform made available by the European Commission, where available.

It is expressly agreed that the data contained in PJTA Ticketing's information systems constitute evidence with regard to orders, requests and other elements relating to use of the Site. They may validly be produced, notably in court, as evidence in the same way as any written document, subject to proof to the contrary.

Article 17. Linked travel services

If, after choosing and paying for a travel service within the meaning of Article L.211-1 of the Tourism Code, the Customer books additional travel services for their trip or holiday through PJTA Ticketing, they are informed that they will not necessarily benefit from the rights applicable to package travel, unless the legal conditions for classification as a package are met.

Any pre-contractual information specific to package travel or linked travel services shall be communicated to the Customer where the nature of the Service requires it. Contracts concluded with third-party Partners may be subject to the Partners' own conditions.

Article 18. Miscellaneous provisions

The fact that PJTA Ticketing does not rely, at a given time, on any one of the provisions of these T&Cs cannot be interpreted as a waiver of the right to rely on it later.

If one of the provisions of the T&Cs were declared null or unenforceable, the other provisions would remain fully effective, unless the annulled provision constituted a determining condition of the parties' commitment.

PJTA Ticketing reserves the right to amend these T&Cs at any time. The applicable version is the one in force on the day of the Customer's order or booking, unless a mandatory provision provides otherwise.
